Statement from ACOE

June 30, 2025 – With regards to the stay the Fiscal Oversight Trustee placed on an OUSD Board action to dismiss a lawsuit, ACOE clarifies that the Alameda County Superintendent of Schools does not have legal authority over the status of any OUSD lawsuit and has not taken any actions related to this specific lawsuit. The Trustee has independent authority to take actions that support OUSD’s best financial interests. The County Superintendent cannot direct the actions of the Trustee.

To support OUSD’s local control, the County Superintendent of Schools has aggressively pursued OUSD's exit from state receivership. The County Superintendent shares this goal with OUSD District leadership, its Board, and its labor partners. Ending receivership, and thus the role of the Fiscal Trustee, as soon as OUSD meets the criteria (which it does today, June 30) is the best means of assisting the OUSD Board to immediately and fully assert its decision-making authority and direct its future.

The Alameda County Office of Education (ACOE) has oversight responsibilities for school districts' budgets and educational plans, and we serve as a school district and provide programs to Alameda County’s most vulnerable students. As an education leadership agency, ACOE also provides training and support services for educators.
